Purpose and Merchant Identity

These terms govern the use of carthislab.com and purchases made with Méditerranée Distribution Inc., doing business as CARTHIS LAB. Souvenir is a fragrance line and not a contracting entity.

Acceptance and Capacity

By using the site or placing an order, the user accepts the terms presented, subject to mandatory laws. The user represents that they have the necessary legal capacity or are acting with the required authorization.

Permitted Use

The site may not be used for illegal or fraudulent purposes, to harm its security, or to infringe on the rights of others.

Products and Availability

Essential product characteristics and price are presented before purchase. Availability may change.

Images, colours, and descriptions are prepared with care. Screen variations or the subjectivity of scent perception do not reduce the product's obligation of conformity.

Order Process and Contract Formation

Before confirming, the customer may verify their cart, address, fees, taxes, total cost, options, and displayed delivery timeframe. The store then sends a confirmation allowing the relevant information to be retained.

If the company is objectively unable to fulfill an order — genuine unavailability, obvious error, or reasonably suspected fraud — it may take legally permitted measures, inform the customer, and refund without undue delay any amount collected for what will not be supplied. This clause does not reduce the customer's remedies.

Price, Taxes, Shipping, and Promotions

Price, taxes, shipping fees, and the total are displayed before confirmation. Shipping fees and options depend on the address, the order, and available services. For international orders, customs duties or import taxes may apply and are the customer's responsibility, as detailed in our Shipping Policy.

Promotions are temporary and subject to the conditions clearly displayed with the offer.

Payment

Payment methods are those displayed at checkout. Payments are processed according to Shopify's configuration and that of the relevant providers. The customer must provide accurate information and be authorized to use the chosen payment method.

Shipping, Returns, and Refunds

The Shipping Policy and the Return and Refund Policy form part of the information applicable to the order. No handoff to the carrier automatically transfers all risk to the customer.

Legal Warranties

All products benefit from applicable legal warranties, including as to fitness for their intended use, reasonable durability, conformity with description, and absence of hidden defects. No clause on the site excludes or restricts them.

Intellectual Property and Third-Party Trademarks

The site's original content is protected as described in the Legal Notice. References to third-party trademarks are descriptive or comparative and do not imply any affiliation, endorsement, or sponsorship.

Links and External Services

The site may provide access to third-party services. We do not control their sites or independent practices.

Liability

To the extent permitted by law, no party is liable for indirect losses that do not reasonably result from a breach attributable to it. This does not apply where an exclusion or limitation is prohibited, notably with respect to legal warranties or mandatory consumer rights.

Events Beyond Reasonable Control

An event beyond a party's reasonable control may delay performance to the extent recognized by law. This clause does not remove any right of cancellation, refund, or other remedy provided by law.

Changes to the Terms

These terms may be updated for the future. The version applicable to an order is the one communicated to the customer at the relevant time.

Severability and Waiver

If a clause is declared invalid, the others remain applicable to the extent permitted.

Governing Law and Dispute Resolution

These terms are governed by the applicable laws of Québec and Canada. Any recourse may be brought before the court or competent authority in accordance with the law. No exclusive jurisdiction in Québec is imposed on the consumer.
